TERMS OF SERVICE

You must be at least 18 years old to use the Application. By using the Application, you represent and warrant that you meet this age requirement.

The Application is intended strictly for educational and motivational purposes. It does not provide medical, psychological, therapeutic, financial, legal, or other professional services.

Use of the Application does not create any professional-client, therapist-client, advisory, fiduciary, or similar relationship between you and the Administrator.

THE POWER APP is a personal development application that includes AI-generated content, daily lessons, challenges, and motivational tools.

The Administrator reserves the right to modify, suspend, or discontinue any part of the Application at any time for maintenance, technical updates, security reasons, or business purposes.

The Administrator does not guarantee uninterrupted, error-free, or secure operation of the Application.

Certain features of the Application may require a paid subscription ("Premium" or "Pro").

Billing

All subscriptions are processed and managed exclusively by:

• Google Play Billing (Android users)
• Apple App Store (iOS users)

Auto-Renewal

Subscriptions automatically renew unless auto-renew is disabled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation

You may cancel your subscription at any time via your Google Play or Apple ID account settings. Cancellation stops auto-renewal, but you will retain access to paid features until the end of the current billing cycle.

Refunds

All payments are non-refundable by the Administrator. Refund requests must be submitted directly to Google Play or the Apple App Store and are subject to their respective refund policies.

The Application includes AI-generated content intended to support personal development, influence, strategy, and motivation.

The AI system is an automated tool. It is not a human professional, therapist, advisor, or licensed specialist.

Any suggestions, strategies, or content generated by the AI:

• Do not constitute medical, psychological, financial, legal, or professional advice.
• Should not be relied upon as a substitute for professional consultation.
• Are provided for informational and motivational purposes only.

No Guarantee of Results

The Administrator does not guarantee any specific personal, financial, occupational, psychological, emotional, or social outcomes from using the Application.

You remain solely responsible for your decisions, actions, and interpretations based on AI-generated content. You use the Application entirely at your own independent discretion and risk.

The Application is provided on an "as is" and "as available" basis without warranties of any kind, express or implied.

To the fullest extent permitted by applicable law, the Administrator shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from:

• Your use of or inability to use the Application,
• Reliance on AI-generated content,
• Errors, inaccuracies, or interruptions of service.

Financial Cap

In no event shall the Administrator's total aggregate liability exceed the total amount paid by you (if any) for the Application's services within the twelve (12) months preceding the event giving rise to the claim.

Nothing in these Terms shall exclude or limit liability where such limitation is not permitted under applicable law, including liability for intentional misconduct or gross negligence where legally applicable.

You agree to indemnify, defend, and hold harmless the Administrator from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:

• Your misuse of the Application,
• Your violation of these Terms,
• Your violation of any applicable law,
• Your infringement of the rights of any third party.

You are solely responsible for your interactions and the information you provide within the Application.

You agree not to:

• Submit unlawful, abusive, manipulative, harmful, or malicious content.
• Attempt to reverse engineer, copy, extract, modify, or replicate the Application or its AI configurations.
• Circumvent security mechanisms or attempt unauthorized access.
• Use the Application in violation of any local, national, or international law.
• Share highly sensitive personal data (e.g., severe medical conditions, financial credentials, classified information) within AI interactions.

All rights, title, and interest in and to the Application — including its design, structure, branding, AI configuration, databases, written content, and visual assets — are owned by the Administrator or properly licensed.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Application strictly for personal, non-commercial purposes.

You may not reproduce, distribute, modify, publicly display, create derivative works from, or commercially exploit any part of the Application without prior written consent.

The Administrator may suspend or terminate your access to the Application if you:

• Breach these Terms,
• Engage in unlawful conduct,
• Threaten the security, stability, or integrity of the Application.

Upon termination for such reasons, your right to use the Application will immediately cease.

The Administrator reserves the right to modify these Terms at any time.

Changes may include:

• Feature updates or removals,
• AI model adjustments,
• Subscription pricing updates (subject to app store requirements and user consent where applicable).

Continued use of the Application after changes become effective constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of Poland.

If you are a consumer residing in the European Union, nothing in these Terms deprives you of mandatory consumer protections granted under the laws of your country of residence.
